1. Introduction

Welcome to Love Shirt (“we,” “us,” or “our”). These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Love Shirt, concerning your access to and use of the https://ms-propertymaintenance.co.uk/ website (the “Site”).

By accessing the Site, you confirm that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, you are expressly prohibited from using the Site and must discontinue use immediately.

2. Products and Services (Made-to-Order)

We offer two types of products on our Site:

  • Standard Collections: Pre-designed apparel and accessories featuring our original designs.

  • Custom Products: Items that are personalized by you using your own images, text, or designs.

Please note that all products, including Standard Collections, are made-to-order. We do not hold inventory; each item is printed and crafted specifically for you once an order is placed.

3. User-Generated Content (For Custom Orders)

If you use our customization tools to upload images, text, or designs (“User Content”):

  1. Ownership: You represent and warrant that you own the copyright to the User Content or have explicit permission to use it.

  2. Restrictions: You agree not to upload content that is illegal, offensive, pornographic, hate speech, or infringes on the intellectual property rights of others.

  3. Right to Refuse: Love Shirt reserves the right to refuse to print any order that violates these terms. In such cases, your order will be canceled and refunded.

4. Accuracy of Colors and Sizing

We strive to display product colors and images as accurately as possible. However, we cannot guarantee that your computer monitor’s display of any color will be accurate.

  • Printing: Actual print colors may vary slightly from what you see on screen (RGB vs CMYK).

  • Sizing: Please refer to our Size Guide before purchasing. Since sizing norms vary by region/brand, we are not responsible for variations if the Size Guide was not consulted.

5. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.

6. Return and Refund Policy

Please review our separate Shipping & Refund Policy posted on the Site prior to making any purchases.
Key Note: Because our products are made-to-order, we generally do not accept returns for buyer’s remorse or wrong size selection. We will, however, provide a free replacement or refund if the product is defective or damaged upon arrival.

7. Affiliate & Brand Ambassador Program

If you join our Affiliate Program (also referred to as the Brand Ambassador Program), you agree to the following terms in addition to the general Terms and Conditions:

7.1. Commission & Discounts

  • Referral Code: You will be assigned a unique discount code (e.g., giving 5% off) to share with your audience.

  • Commission Rate: You will earn a starting base commission of 5% on the “Net Sales” of eligible orders.

  • Performance Bonuses (Tiered System): We reward top performers! Your commission rate will automatically increase by 1% for every 100 eligible orders completed using your referral code. Example: Once you reach 100 total orders, your rate becomes 6%; at 200 orders, it becomes 7%, and so on.

  • Net Sales: Commission is calculated based on the product price after discounts and excluding shipping costs, taxes, and duties.

7.2. Payouts

  • Threshold: You must earn a minimum of $100 USD in commissions before a payout can be requested.

  • Payment Method: All payouts are processed via PayPal. You must provide a valid PayPal email address in your affiliate account settings.

  • Schedule: Payouts are processed manually upon request or on a monthly basis, provided the threshold is met.

7.3. Refunds & Chargebacks

  • Commissions are approved only after the return period has passed.

  • If a customer refunds an order or requests a chargeback, the corresponding commission earned by the affiliate for that order will be deducted/revoked from their account balance.

7.4. Prohibited Activities

  • We reserve the right to terminate your affiliate account immediately if we suspect spamming, fraud, or behavior that damages our brand reputation.

8. User Representations

By using the Site, you represent and warrant that:
(1) all registration information you submit will be true, accurate, current, and complete;
(2) you have the legal capacity and you agree to comply with these Terms and Conditions;
(3) you are not a minor in the jurisdiction in which you reside;
(4) you will not use the Site for any illegal or unauthorized purpose.

9. Limitation of Liability

In no event will Love Shirt, our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site.
